General Terms of Sale

Preamble

Our General Sales Terms are available in French as « Conditions Générales de Vente » 

This translation is only here as information; it has no legal value. The only legitimate document is the French version of our General Sales Terms. 

MAJESTICFILATURES RETAIL (the "Company" or "MAJESTICFILATURES RETAIL") is the company in charge of the www.majesticfilatures.com and www.majesticfilatures.be websites (the "Website").

For the purposes hereof, it is agreed that the Customer and MAJESTICFILATURES RETAIL will be referred to as the "Parties" and individually as a "Party". These terms and conditions (hereinafter as the "General Sales Conditions") guide the products sales made by MAJESTICFILATURES RETAIL (the "Products") to any individual purchasing a product on the website.

ARTICLE 1 : OBJECT

The purpose of these General Sales Terms is to define the conditions under which the Products are sold by MAJESTICFILATURES RETAIL to the Customer. They also include the various steps to complete the process of sale: from placing the order by the Customer to the delivery of the Product. 

MAJESTICFILATURES RETAIL reserves the right to modify the General Sales Terms at any time by publishing a new version on the Website. The applicable General Sales Terms is the actual one on the Website at the time the order is placed by the Customer. Placing an order for a Product offered on the Website and checking the box indicating that the Customer accepts the General Sales Terms indicates the Customer's full acceptance of the General Sales Terms.

ARTICLE 2 : PRODUCTS

2.1 Products

The Products offered for sale by MAJESTICFILATURES RETAIL are the ones displayed on the Website on the day of their consultation. The pictures illustrating the Products are not contractual, each Product also has a descriptive sheet.

The offers presented are valid for as long as they are announced on the Website following the availability of stocks. 

The offers presented are valid according to their availability. The information concerning the availability of products is provided to the Customer in the moment an order is placed. 

In the event of the unavailability of a product after an order has been placed: 

  • The Customer will be informed by email as soon as possible.

  • The Customer Service will contact the Customer to inform them of the cancellation of their Order and offer the placement of a new one, with the exception of the product that is not available.

  • The unavailable product will be refunded to the Customer on the bank card used for the purchase.


2.2 Guarantees

The Company commits to delivering the Products complying with The French and European provisions, particularly the ones related to people’s safety and health and the legislation on controlled chemical substances.  

Legal guarantees

Any lack of conformity of the Products purchased on the Website is guaranteed by the Company under the conditions of the article L. 217-4, following the Consumer Code, including any hidden defects on an item sold following the conditions provided by articles 1641 and the Civil Code. 


As part of the legal guarantee of conformity implementation, the Customer:


  • Has a period of two (2) years from the delivery of the products to take action.

  • Can choose between repairing or replacing the Product, in accordance with article L. 217-9 of the Consumer Code.

  • We can however choose not to follow the customer’s choice if this choice involves a disproportional cost in the eyes of the other modality, including the product’s value and the importance of the defect. If the repair or replacement of the product is impossible, the Customer can choose between the partial restitution or the termination of the contract, in accordance with article L. 217-10 of the Consumer Code;


- it is exempted from providing proof of the existence of the product inconformity during the 24 months following the products delivery.

- can decide to implement the guarantee against hidden product defects according to the article 1641 of the Civil Code and in this case, he can choose between the resolution of the sale or a reduction of the sale price according to the article 1644 of the Civil Code.

In the case of a reception of any Product that presents a defect or is damaged in any way, please report the defect immediately, to us or to the delivery person. Failure to report defects doesn’t deprive you of benefitting from the legal guarantees. The Company will take charge of the fees related to their exchanges. The Products are returned to the Company under the responsibility of the Customer. The Company can’t be held responsible for returned products that were damaged during their transportation or delivery. 

ARTICLE 3 : PRICES

The prices are indicated in euros with taxes included, excluding delivery costs.

The Company reserves the right to change its prices at any time, but the products ordered are invoiced at the price registered at the time the order is placed. 

The delivery fees are communicated to the Customer on the summary of the order before its validation; all taxes included, except special offers. These fees are the Customer’s responsibility and are invoiced in addition to the products sale price.

The product’s loss and deterioration risks will be transferred after the delivery and reception confirmation by the Customer.

 

ARTICLE 4 : ORDER AND PAYMENT OF PRODUCTS

4.1 Placing the order

- Step 1: the Client checks the contents of his shopping cart and he can modify his order (product, size, quantity).

After checking the order and changing it if necessary, the Customer selects the country of delivery and then validates the shopping cart in order to finalize the order by clicking on the button "proceed to checkout".

- Step 2: The Client registers on the website or creates a new account.

- Step 3: The Client checks his delivery address, accept the General Sales Terms and by clicking on the button "validate and pay my order" he accesses the partner banking website page .

- Step 4: Entering bank details: Customer will access then the secure payment screen from MAJESTICFILATURES RETAIL banking partner.

Payment is made online by credit card through the platform of the MAJESTICFILATURES RETAIL banking partner or by Paypal through the Paypal platform. 

4.2 Order Confirmation

Upon payment validation, the Customer will receive an email confirming his order. The confirmation will include all the items ordered, the billing and delivery addresses, as well as a copy of the invoice referring to the General Sales Terms.

The validation of the order by the Customer and the order confirmation sent to the Customer by email by MAJESTICFILATURES RETAIL following the validation of payment constitute the conclusion of a sales contract between the Parties and the acceptance of the General Sales Terms.

The Customer who has placed an order will have the option of printing his invoice by logging onto the Website at the order tracking space provided for this purpose.

MAJESTICFILATURES RETAIL reserves the right not to validate the order in the event of legitimate reason, following the article L.121-11 of the Consumer Code, in particular if the Customer is the author of abnormal or abusive complaints, abnormal orders with regard to the quantities ordered, abnormal or abusive exchanges and returns, or in the event of an existing dispute with the Customer regarding a payment incident.

The MAJESTICFILATURES RETAIL Customer Service is available to the Customer for any questions relating to their order. The Customer Service is available by email:

4.3. Payment

The price of the Products purchased is payable for its full amount on the day the order is placed by the customer.

The Payment is made online by credit card (CB / VISA / MASTERCARD / AMEX) or Paypal at the time of the validation of the order by the Customer.  The payment authorization request is made at the time of the confirmation of the order on the Website.

The payment of your order can be made in 3 times free of charge from a minimum of 150€ of purchase using our partner Alma for orders to France, Germany and Spain. If you choose to pay your order in multiple times, you are in agreement with Alma General conditions of payment.

After confirmation of your payment by our payment provider, your bank account or your Paypal account will be charged the total amount of your order.

In the event of a payment error, an incorrect address or any other problem related to the Customer's account, MAJESTICFILATURES RETAIL may block the Customer's order until the problem is resolved.

In the event of fraudulent use of their bank card on the Website, the Customer is invited to contact MAJESTICFILATURES RETAIL by e-mail at the following address serviceclients@majesticfilatures.fr.

The ttransactions made through the Website are secured by MAJESTICFILATURES RETAIL's partner payment system, the HSBC bank.

All the information exchanged to process the payment is encrypted using the SSL (Secure Socket Layer) protocol. This data cannot be detected, intercepted or used by third parties.

At no time does the Customer's financial data is passed through the MAJESTICFILATURES RETAIL computer system.

The bank verifies that the connection with the customer’s browser is secure before sending the payment form to the banking institution that performs the financial transaction.

In the event of a technical problem preventing the payment, you will receive an error message from the bank.

You will then have to renew the payment authorization request; and you will only be debited for the payment amount once.

In the event of a payment default or any other problem with the Customer's account, the Company may block the Customer's order until the problem is resolved.

In the event of fraudulent use of their bank card on the website, the Customer must contact their bank, the one that issues the card used.

The Customer is also invited to contact the Company by e-mail at the following address serviceclients@majesticfilatures.fr.

The bank is a technical service provider, and it does not take charge of claims related to orders, which are processed directly by the Company as specified above or, where applicable, by the Customer's bank.

4.4. Archiving of the order

The order confirmation is recorded at the Company's registers, which are stored at a reliable and durable back-office. 

The Customer accepts that the order confirmation is considered as proof of the contractual relation between the Parties.

ARTICLE 5 : DELIVERY

The Company uses the services of LAPOSTE, CHRONOPOST and UPS for the shipping and delivery of products ordered by the Customer.

Deliveries take place within the time specified when placing the order.

The delivery time corresponds to the shipping time indicated at the time of ordering, which includes the preparation time.

We also make international deliveries, except to Afghanistan, Åland Islands, Andore, Angola, Anguilla, Antigua and Barbuda, Netherlands Antilles, Aruba, Australia, Azerbaijan, Bahamas, Barbados, Belarus, Belgium, Belize, Benin, Bermuda, Bhutan, Botswana, Bouvet Island, Brunei Darussalam, Burkina Faso, Burma (Myanmar), Burundi, Cayman Islands, Cameroon, Canada, Central African Republic, Christmas Island, Cocos (Keeling) Islands, Comoros, Rep. The Customer is informed that the prices and delivery times vary according to the country chosen by the customer as the delivery address at the time of his order and which is considered the authentic address.

Depending on the Customer's selection, the corresponding price will be indicated automatically in the order process and will appear on his order summary.

If your delivery country is situated outside of the EU or Overseas, it is possible that your package may have Customs fees, importation fees or different taxes that are not included in the final amount of your order. If you receive an email or a call concerning this subject, it is your responsibility to pay these fees to retrieve your order. If you refuse to pay these fees, your order will be returned to us. We will then proceed with a partial refund of your order since we will be obliged to deduct the delivery costs and the customs fees.

For further information and not to have any unpleasant surprises, please contact your Customs office.

In case of a breach of our delivery obligation regarding the date indicated or within the time limit, you can cancel your order, by registered letter with signature or in writing (email sent to serviceclients@majesticfilatures.fr) if, after communicating to us by registered letter or by any other writing concerning the delivery within a reasonable additional time, we have failed to deliver to you within the time limit.

In the event of cancellation of the contract, we will proceed to the full refund of your purchase, shipping costs included, using the payment method used during your purchase, unless expressly agreed by you. The refund will take place within fourteen (14) days from the date of cancellation of the contract.

ARTICLE 6 : RECEIPT OF THE ORDER - COMPLAINTS - RETURNS

Following the article L.221-18 of the Consumer Code, the Customer has a period of fourteen (14) open days from the reception of the Products by himself or a third party, other than the carrier, designated by him, to exercise his right of withdrawal without having to justify reasons or pay penalties, with the exception of the fees of returning the Products in question, which must be all returned at once, in perfect condition, unworn, unwashed, in their packaging and with the original labels, to:

at the latest within fourteen (14) days of the communication of the decision to withdraw.

The Customer must state his wish to return the Product (s) by means of an unambiguous declaration (for example, standard form to be completed online on the site, email). The Customer can follow the return procedure through "My account", "My order history", "see details" and wait for the validation of the return by the Customer service.

The risks and costs of return are the sole responsibility of the Customer.

We recommend that the Customer use a tracking shipment and insure the shipment to avoid any disputes.

Following Brexit and the new procedures implemented in 2022, the Customs fees and charges regarding the United Kingdom are to be payed before sending the return packages. These charges are the customer’s responsibility and the absence of payment leads to the impossibility of reception of the package by our logistics.

When non-compliance has been noted, MAJESTICFILATURES RETAIL will offer the Customer:

  • Replacement of the Product (s) charged to MAJESTICFILATURES RETAIL.

  • Refund of the price of the returned Products and delivery costs, at the latest within fourteen (14) days from the date on which the MAJESTICFILATURES RETAIL Customer service has been informed of the Customer's decision to withdraw.

Orders paid in part or in full using a voucher will be subject to a new voucher in the event of items return.

ARTICLE 7 : PERSONAL DATA

MAJESTICFILATURES RETAIL collects certain information necessary to process the orders. This data is not only necessary for processing the customer's order by MAJESTICFILATURES RETAIL, but also to communicate to the Customer the information on the brand, on the Website or to make him benefit from commercial offers; only if the Customer accepts it when validating his order and creating a customer account.

ARTICLE 8 : COOKIES

In order to process the customer's order, and to better understand their needs and personalize the services offered on the website, MAJESTICFILATURES RETAIL uses cookies.

ARTICLE 9 : LIMITATION OF LIABILITY

Placing an order on the Website implies knowledge and acceptance of the procedures up to date on the Internet, in particular regarding technical performance, response times, connection times, inquiries or information transfers, cut risks, contamination risks by viruses circulating on the network and all the general risks linked to the use of the Internet.

MAJESTICFILATURES RETAIL can therefore in no way be held responsible for any direct or indirect damage resulting from improper use or incident related to the use of the computer, Internet access, maintenance or malfunction servers, telephone line or any other technical connection. The Customer's connection to the Website is his sole responsibility.

ARTICLE 10 : MAJOR FORCE

MAJESTICFILATURES RETAIL will not be responsible for the total or partial non-execution of its obligations under the order placed by the Customer, if this non-execution is caused by an event constituting a case of force majeure as defined by the applicable right.

In such an event, MAJESTICFILATURES RETAIL will inform the Client of the occurrence of such an event within three (3) (three) clear days of its occurrence, by email.  

After a period of one (1) month, and in the event that the event constituting a case of force majeure persists, the order will be canceled and will be subject to a refund of MAJESTICFILATURES if necessary RETAIL on the bank card used to place the order within a maximum period of thirty (30) days.

 

ARTICLE 11 : LAW

The General Sales Terms is executed and interpreted in accordance with the French law.

In the event of claims relating to the interpretation or execution of the General Sales Terms, the Customer must first address MAJESTICFILATURES RETAIL to reach an amicable solution.

The Client has the possibility of submitting any complaints at the claim resolution platform set online by the European Commission at the following address: HTTPS://EC.EUROPA.EU/CONSUMERS/ODR/MAIN/INDEX.CFM?EVENT=MAIN.HOME.SHOW&LNG=FR.

The European Commission will transfer the Customer's complaint to the notified certified national mediators.

The Client may also use any other alternative method for the resolution of the claim. Notwithstanding the above, in the event of a claim, in accordance with Regulation No. 44/2001 of December 22, 2000, the French courts will have jurisdiction:

  • you can choose either the court from where you reside, or the court from MAJESTICFILATURES RETAIL headquarters,

  • MAJESTICFILATURES RETAIL may choose the court from where you reside 

In accordance with articles L. 612-1 to L. 612-5 of the Consumer Code, all consumers have the right to have the option of a free consumer mediator regarding the amicable resolution of the dispute between them and a professional company.

To this end, MAJESTICFILATURES RETAIL guarantees the consumer the effective use of a consumer mediation system.
